Nondiscrimination And Interconnection Policy


FiberLight deploys open, general-purpose networks capable of providing crucial basic infrastructure with unrestricted access to service providers. FiberLight is committed to providing networks that are technology and platform neutral, widely deployed, affordable, and accessible. FiberLight networks are open to Federal and State government agencies, commercial entities, and the full range of existing service providers, regardless of use; wireline, wireless, or satellite services, but also to emerging and future uses that have yet to be deployed. As such, FiberLight adheres to the principles contained in the Federal Communication Commission’s Internet Policy Statement (FCC 05-151, adopted August 5, 2005):

  • FiberLight customers are entitled to access the lawful Internet content of their choice.

  • FiberLight customers are entitled to run applications and use services of their choice, subject to the needs of law enforcement.

  • FiberLight customers are entitled to connect their choice of legal devices that do not harm the network.

  • FiberLight customers are entitled to competition among network providers, application and service providers, and content providers.

  • Further, FiberLight does not favor any lawful Internet applications or content over others.

As a wholesale access provider, FiberLight employs a full suite of technical mechanisms that exceed standard best efforts data delivery. FiberLight begins at the physical level by placing a large amount of fiber strands in each of its network rings, which gives FiberLight the ability to provide separate, dedicated dark fiber strands to its service provider customers. Because FiberLight does not provide service directly to end users, it does not manage spam, filter content, or otherwise manage end-user Internet usage. With respect to the capacity it provides to its service provider customers, FiberLight’s bandwidth allocation techniques are content and application-neutral, and are used only to ensure that all customers receive acceptable levels of service. FiberLight does not favor any lawful Internet applications or content over others.

FiberLight offers interconnection, where technically feasible without exceeding current or reasonably anticipated capacity limitations, on reasonable rates and terms to be negotiated with bona fide requesting parties. This includes both the ability to connect to the public Internet and physical interconnection for the exchange of traffic. FiberLight also provides wholesale access to network components and services at reasonable rates and terms. The company employs a fixed pricing structure for each type of service provided which is available to all government agencies, commercial entities, and communication service providers on a nondiscriminatory basis.

FiberLight will notify its customers of changes to this policy.
